1. Acceptance of Terms

By downloading, installing, or using the Focus Buddy mobile application ('App'), you agree to be bound by these Terms of Service. If you do not agree to these Terms, you should not use the App.

2. Description of Service

Focus Buddy is an ADHD-friendly focus timer application that helps users improve focus and productivity through an emotional companion system. The App features an artist buddy who helps find scattered pencils, room decoration rewards, focus session tracking, and ADHD-supportive features. The App includes both free features and premium features available through in-app purchases on iOS and Android.

3. Account Registration

You may use basic focus timer features without registering an account. However, to access premium decorations, sync your room progress across devices, or backup your artist buddy customizations, you may need to create an account. You are responsible for maintaining the confidentiality of your account information and for all activities that occur under your account.

4. User Content

You retain all rights to any content you create within the App, including custom focus session notes, room decoration arrangements, or artist buddy customizations. By using the App, you grant Focus Buddy a worldwide, non-exclusive, royalty-free license to store and sync such content solely for the purpose of providing the App's services to you across your devices.

5. ADHD Support Features and Content Accuracy

The App provides ADHD-supportive features and focus strategies based on current research and best practices. While we strive to provide helpful tools for neurodivergent individuals, we cannot guarantee specific outcomes or results. Users should consult with healthcare professionals for personalized ADHD treatment and support.

6. Medical Disclaimer

The App is designed as a productivity and focus support tool and is not a medical device or treatment. Focus Buddy does not provide medical, psychological, or professional ADHD treatment advice. The app is intended to supplement, not replace, professional care. Always consult with qualified healthcare providers for ADHD diagnosis and treatment.

7. Subscription and Payments

Focus Buddy offers both free focus features and premium decorations/customizations. Premium features may be available through one-time purchases or subscription plans processed through the Apple App Store or Google Play Store. Payment for premium room decorations, artist buddy customizations, and advanced features is processed by the respective store, and all subscription management and cancellations must be handled through your store account settings. Prices for premium features are displayed in the App and may change at any time. Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current period.

8. Refund Policy

All purchases made through the App are subject to the refund policies of the Apple App Store or Google Play Store. Focus Buddy does not directly process refunds for in-app purchases or subscriptions. To request a refund, please contact the respective store's support directly.

9. Intellectual Property

The App, including all content, features, and functionality, is owned by Focus Buddy and is protected by international copyright, trademark, patent, trade secret, and other intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of the App without our prior written consent.

10. Prohibited Activities

You agree not to engage in any of the following prohibited activities: (1) copying, distributing, or disclosing any part of the App; (2) using any automated system to access the App; (3) attempting to interfere with the proper working of the App; (4) uploading invalid data, viruses, or other harmful code; (5) collecting users' information without their consent.

11. Termination

We reserve the right to suspend or terminate your access to the App at any time for any reason, including but not limited to a violation of these Terms. You may also terminate your use of the App by deleting it from your device.

12. Disclaimers

The App is provided 'as is' and 'as available' without warranties of any kind, either express or implied. We do not warrant that the App will be uninterrupted or error-free, that defects will be corrected, or that the App is free of viruses or other harmful components.

13. Limitation of Liability

To the maximum extent permitted by applicable law, Focus Buddy and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or use, arising out of or in connection with these Terms or your use of the App.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Poland, without regard to its conflict of law provisions.

15. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of significant changes by posting a notice in the App or by sending you an email. Your continued use of the App after such modifications constitutes your acceptance of the modified Terms.

16. App Store and Google Play Additional Terms

These Terms are between you and Focus Buddy, not with Apple or Google. Apple and Google are not responsible for the App and its content. However, Apple and Google are third-party beneficiaries of these Terms and have the right to enforce them against you. You represent and warrant that you are not located in a country subject to a U.S. Government embargo or designated as a 'terrorist supporting' country, and you are not listed on any U.S. Government list of prohibited or restricted parties.
